Introduction
Welcome to Gleam, a digital legacy service that allows you to create messages that will be delivered to your loved ones after you're presumed deceased. These Terms of Service ("Terms") govern your use of the Gleam website, services, and applications (collectively, the "Service").
Please read these Terms carefully before using the Service. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.
1. Agreement to Terms
By accessing or using the Service, you confirm that you accept these Terms and agree to comply with them. If you are using the Service on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms.
2. Service Description
Gleam is a digital legacy service that allows users to create messages that will be delivered to specified recipients after the user is presumed deceased based on inactivity criteria.
The Service is provided "as is" with no guarantee of availability or continuity. While we strive to maintain a reliable service, we cannot guarantee that the Service will be available at all times or that messages will be delivered as intended in all circumstances.
3. User Accounts
To use the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
4. Fees and Payments
The Service may include paid features. Payment terms will be specified at the time of purchase.
Fees are non-refundable, except where required by law. If you delete a message that hasn't been delivered, the associated credit will be returned to your account for future use, but no monetary refund will be provided.
5. Intellectual Property
The Service and its original content, features, and functionality are owned by Gleam and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
6. User Content
You retain all rights to the content you submit to the Service. By submitting content, you grant us a non-exclusive, royalty-free license to use, store, and process that content solely for the purpose of providing the Service.
You are solely responsible for the content you submit. You agree not to submit content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
7. Prohibited Activities
You agree not to engage in any of the following prohibited activities:
- Using the Service for any illegal purpose or in violation of any laws
- Posting or transmitting harmful content, including malware or viruses
- Impersonating another person or entity
- Interfering with or disrupting the Service or servers connected to the Service
8. Limitation of Liability
To the maximum extent permitted by law, Gleam and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.
Our liability is limited to the amount you paid for the Service in the 12 months preceding the claim or $100, whichever is greater.
9. Indemnification
You agree to indemnify and hold harmless Gleam and its officers, directors, employees, and agents from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from your use of the Service or your violation of these Terms.
10. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the new Terms on the Service and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Quebec, Canada, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the courts located in Montreal, Quebec, Canada.
